What types of business disputes are a good fit to be resolved through alternatives to litigation?

The short answer is that all commercial disputes are potentially a good fit to be resolved outside of litigation by using processes such as arbitration or mediation.

To be sure, there are exceptions such as when disputes are especially bitter. But businesses generally tend to prefer alternative dispute resolution processes because of efficiency. Keeping costs down is usually an important factor in business disputes. Parties can also generally resolve the matter much quicker than would be the case in having to use the court system.

What are some of the keys to achieving your goals through negotiation without going to trial?

Negotiation is done most effectively when both sides can acknowledge strengths and weaknesses. When there is sufficient candor and transparency, the path toward settlement or some other sensible resolution can open.

Granted, this can be easier said than done. But being clear about facts and legal claims can be key to moving forward without having to engage in extended (and costly) business litigation. And if the other party is dragging their feet, you can still keep preparing your case for trial.
